Florida Oversight Rules for Daytona Beach Clinics

Florida sets different oversight rules for each license on your team. Here’s what applies in Daytona Beach and the statute behind each rule.

Florida APRNs work under a written protocol with a supervising physician, who files notice with the Board of Medicine within 30 days (§458.348). Autonomous registration covers primary care only, so an NP running a medspa, weight loss, or hormone clinic still needs that protocol.

Each Florida PA works under a Florida-licensed physician, and one physician can supervise up to 10 PAs at a time (§458.347). The physician also notifies the Board of Medicine when delegating prescribing authority.

RNs give medications and treatments as a licensed practitioner prescribes or authorizes them, so injectors need written orders and delegation protocols (ch. 464). Estheticians stay within non-medical skin care under their facial specialist license (ch. 477).

When an NP or PA runs a mostly aesthetic office without the physician onsite, the physician must be board certified or board eligible in dermatology or plastic surgery (§458.348(3)(c)). That physician can cover one such office, located within 25 miles or in a contiguous county. Volusia borders Flagler, Seminole, and Brevard, so a qualifying physician in Palm Coast or Sanford can supervise a Daytona Beach office.

APRNs and PAs can prescribe controlled substances, with Schedule II supplies capped at seven days unless a psychiatric nurse prescribes psychiatric medication. Both complete three hours of controlled substance CE each renewal cycle.

A clinic not wholly owned by eligible practitioners may need an AHCA Health Care Clinic License, and that license requires a medical director or clinic director who accepts legal responsibility in writing (§400.9905, §400.9935). Florida physicians must also carry malpractice coverage or show financial responsibility under §458.320, and we confirm coverage before your physician signs on.

These are the gaps we look for when a Daytona Beach clinic comes to us with an existing agreement:

  • A signed protocol with no Board of Medicine notice on file
  • An NP-run aesthetic office supervised offsite by a physician outside dermatology or plastic surgery
  • An RN injecting without a written delegation protocol for each product
  • An NP assuming autonomous registration covers aesthetics or weight loss
  • Agreements that lapsed after a physician change

FAQs

Frequently Asked Questions

Any Daytona Beach medspa offering Botox, fillers, laser treatments, or IV therapy needs a Florida-licensed physician overseeing those services. NPs work under a written protocol, PAs work under physician supervision, and RNs follow physician orders. Clinics holding an AHCA Health Care Clinic License must also appoint a medical director or clinic director in writing.

Florida’s autonomous APRN registration covers primary care only: family medicine, general pediatrics, and general internal medicine. Qualifying takes 3,000 supervised clinical hours within five years plus graduate coursework in pharmacology and differential diagnosis. NPs offering aesthetics, weight loss, or hormone therapy still need a supervising physician protocol.

Florida caps supervision at 10 PAs per physician at any one time under §458.347. The supervising physician also notifies the Board of Medicine when delegating prescribing authority to a PA. Ask how many PAs a physician already supervises before you sign an agreement.

Florida permits offsite supervision in most settings, with limits on how many offices one physician oversees. Aesthetic skin care offices run by an NP or PA without an onsite physician follow stricter rules under §458.348. There, the physician must be board certified or board eligible in dermatology or plastic surgery and practice within 25 miles or a contiguous county.

We match most Daytona Beach clinics with a Florida-licensed physician within 24 hours. Our team then prepares your protocol and delegation documents for you to review and sign. Same-day intro calls with a physician are available if you want to talk first.

Florida doesn’t limit medspa ownership to physicians. Entities wholly owned by eligible practitioners, including physicians, PAs, and APRNs, generally qualify for an exemption from AHCA clinic licensing. An RN-owned clinic usually needs the license, which requires a written medical director or clinic director appointment.
